The hiring of foreigners in origin is a process by which companies in Spain can hire foreign workers residing in their countries of origin to come and work in Spanish territory.

Requirements

The following requirements must be met in order to carry out the hiring of foreigners in origin:

  • In order to be eligible for hiring at source, the functions of the hired worker must be included in the catalog of occupations that are difficult to cover (see the catalog here https://www.sepe.es/HomeSepe/empresas/informacion-para-empresas/profesiones-de-dificil-cobertura/profesiones-mas-demandadas.html)or:
    • Be citizens of Peru or Chile as Spain has bilateral agreements with these countries.
    • Report from the competent Public Employment Services (in Catalonia from the SOC) on the insufficiency of job seekers to fill the position and the job offer presented.
  • Employment contract that complies with Spanish legislation.
  • In some cases the company is obliged to cover the employee’s travel and accommodation costs (consult in each case).
  • Not have a criminal record in Spain and in the country of origin or in the countries in which he/she has resided during the last five years.
  • The company must demonstrate that it complies with its tax obligations and that it is financially sound.

Process

The process for the recruitment of foreigners at origin is as follows:

  • Application at the Immigration Office. The company submits an application to the Government Delegation or Subdelegation in the province where the worker will be working.
  • Obtaining a visa. If the application is approved, the worker must go to the Spanish consulate in his or her country of origin to apply for the work visa.
  • Temporary residence and work permit. The granting of this permit allows the worker to reside and work in Spain during the period established in the contract. Normally, this permit has a limited and specific duration.

Estimated time

The approximate time for the resolution of this procedure is approximately 3 months plus one more month to process the visa.

Mandatory return to country of origin

At the end of the contract, most workers must return to their country of origin, especially when the contract is of a seasonal nature.
